These Terms of Use (“Terms”) govern the access and use of websites, mobile applications, and services , doing business as Powered By Peptides (“powXpep,” “PBP,” “we,” “our,” or “us”), including but not limited to powXpep.com and any associated digital platforms (collectively, the “Site”). These Terms apply to all visitors, users, and others who access or use the Site and any services made available through it (collectively, the “Services”).

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING OUR SITE OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

BINDING ARBITRATION & CLASS ACTION WAIVER: These Terms include a binding arbitration clause and class action waiver. By using the Site, you agree to resolve disputes through final and binding arbitration on an individual basis.

All personal information submitted through the Site is subject to our Privacy Policy, which explains how data may be collected, stored, used, and shared.

Nature of Services

  • Powered By Peptides, the website, does not render medical advice, treatment, or prescriptions.

  • The Site is a management and facilitation platform that connects patients with independent licensed medical providers (“Providers”).

  • These Providers, engaged through licensed medical groups, are solely responsible for all medical care, prescriptions, and treatment decisions.

  • We do not supervise or control the practice of medicine.

  • We do not manufacture, sell, inventory, or ship medications. All prescriptions and pharmacy services are handled directly by licensed providers and pharmacies.

  • Powered by Peptides is not a replacement for a primary care physician. You are encouraged to maintain a relationship with a primary care provider for ongoing and comprehensive health needs.

Our role is limited to:

  • Managing the telehealth process and communications.

  • Coordinating patient intake and scheduling.

  • Providing administrative and facilitation services.

  • Charging fees for management and coordination services, not medical products.

  • Supporting non-clinical business functions.

Medical Emergencies

Do not use the Site for emergencies. If you believe you are experiencing a life-threatening condition, call 911 immediately.

Telehealth Disclosures & Risks

By using the Site, you acknowledge:

  • Telehealth involves electronic communications and may differ from in-person visits.

  • Technical issues may disrupt services.

  • Providers may not have complete access to your medical history.

  • We use security measures, but no system is immune to breaches.

Prescriptions & Pharmacy Services

  • If a Provider determines that a prescription is appropriate, the Provider will issue it.

  • All prescriptions, treatment protocols, and fulfillment are handled solely by independent providers and pharmacies.

  • Prescriptions are not guaranteed and are outside of our control.

Insurance Disclaimer

Our Services are not insurance and should not be considered a substitute for health insurance.

Availability of Services

Services are only available in states where permitted. By using the Site, you represent that you reside in a state where Services are offered.

Returns & Refunds

  • Payments to Powered By Peptides cover management and facilitation services only.

  • Charges remain on hold until a provider reviews your information and confirms treatment appropriateness.

  • If you are approved and agree to proceed, your card will be charged.

  • Once charged, payments are non-refundable if a medication or alternative medication is offered.

  • If you are not approved for any treatment you will not be charged.

  • We do not sell, return, or refund medications, supplements, or lab services. Concerns regarding those must be directed to the dispensing provider or pharmacy.

Payment & Billing

  • You authorize Carblaroe Services LLC to charge your payment method for Services, including recurring charges if applicable.

  • You are responsible for maintaining accurate billing information.

Age Restrictions

The Site is only available to users 18 years or older.

Account Security

You are responsible for keeping your account credentials secure and for activity under your account. Notify us immediately of unauthorized access.

Permitted Use

You agree not to:

  • Interfere with Site operations.

  • Access accounts that are not yours.

  • Use scraping tools or bots.

  • Upload harmful code.

  • Engage in illegal or abusive activity.

Communications

By using the Site, you consent to receive service-related communications. You may opt out of promotional communications.

Intellectual Property

All Site content is owned by Powered By Peptides or its licensors. You may not copy, distribute, or exploit content without permission.

User Content

You are responsible for content you submit. Do not upload false, infringing, or harmful material. We may use de-identified data for analytics.

Third-Party Links

We are not responsible for third-party websites linked through the Site.

Provider Terms

Providers are solely responsible for compliance with applicable laws and their own practice. We are not a party to the provider-patient relationship.

Indemnification

You agree to indemnify and hold harmless Powered By Peptides, Carblaroe Services LLC, and all of it’s providers, affiliates, and parties associated with the platform or the treatment from claims arising from your use of the Site or violation of these Terms.

Arbitration & Governing Law

Disputes will be resolved through binding arbitration under the American Arbitration Association rules in Pennsylvania. You waive jury trial and class action rights.

Limitation of Liability

We are not liable for indirect, incidental, punitive, or consequential damages. Liability is limited to amounts paid to us in the six months prior to a claim.

Disclaimer of Warranties

The Site and Services are provided “as is” without warranties of any kind.

Force Majeure

We are not responsible for failures outside of our control, including outages, disasters, or labor disputes.

Termination

We may suspend or terminate your access to the Site at our discretion.

Entire Agreement

These Terms represent the entire agreement between you and Powered By Peptides and all of its affiliates and providers.

If you are seeking access to a prescription product, powXpep connects you with licensed medical providers who will review your medical history and determine whether you are an appropriate candidate for treatment. If approved, your prescription will be sent to one of our partner pharmacies for fulfillment.

Compounded medications are prepared by licensed U.S. Sterile Compounding Pharmacies and are made specifically for each patient based on a provider’s prescription. These pharmacies follow strict regulatory standards; however, compounded medications are not reviewed or approved by the U.S. Food and Drug Administration (FDA). Because they are customized for each patient, compounded medications may differ from FDA-approved drugs in strength, formulation, or risk profile.

powXpep does not directly provide medical or pharmacy care. All clinical care is provided by independent licensed professionals through secure, HIPAA-compliant telehealth platforms. If a prescription is not approved you will not be charged.
